And exactly why I stopped using eBay a long time ago.
Hello, this mail is regarding eBay item #8824459515, “12 game case carrier HOLDS 12 Nintendo 64 games! NICE!†–
The item arrived today (July 18th, 2006) in extremely damaged and unacceptable condition. Several (7) pieces of plastic were broken off of the case, and only a few (3) of the broken pieces remained in the shipping box, indicating that the item was purposefully sent in this damaged condition. Obviously, a case in this condition cannot hold the advertised (12) number of games.

This is the side of the drawer, which was broken in 3 places. All 3 pieces were in the box and I reattached them with superglue, as seen in the picture.

This is a top view of the damaged item. There are 3 pieces broken in the rear of the drawer’s interior, as well as a 4th piece broken right above my thumb.

Given the above, I feel it is fair that I ask you send a second, undamaged version of this product via expedited mail at no cost to me. Hopefully, you agree.

are you kidding? how dare you insinuate that i shipped this in its arrival condition. that is a poor way of working with someone on something. of COURSE i DID NOT ship this in a broken condition. and your pictures are not downloading and are worthless btw.

It is my right as a customer to complain when a product is received as defective, and it is included in your eBay policy that you are to honor all claims made in your advertisement. This item was obviously shipped in defective condition, and my working pictures prove this. If you would like, I could attach these pictures in a reply to ensure their download and relative ‘worth’.
I would appreciate if you would treat your customers with the same courtesy and respect with which I’ve treated you. If you refuse to comply with my reasonable requests for you to ameliorate an obvious error on your part, I will file a claim with eBay’s safeharbor department, as is my right, again, as a customer.

okay, well, what do you propose?

I would again propose that I either receive a non-broken item shipped at no cost to me or that I receive a full refund, including my paid shipping fees. If you require that I send the broken item back, I would require that I receive the funds with which to ship it. I would expect no less and no more from any professional online outlet.

Again, no, this does not hold games just fine, as the broken pieces are from the slots that hold the games. How would you like it if you bought something that was supposed to be a collectible item in good condition – “NICE!†even – and when you received it, it was scratched up and broken, and when you contacted the seller, they first called you a liar and then basically said ‘it works well enough?’
I was not and am not in the market for something that is broken and that looks and operates like junk as a result. I was in the market for an attractive case for my N64 games. Not junk. This is junk. You have sold me junk in place of the item I was promised. I am upset. I want what I paid for or I want my money back. You want me to shut up and go away while you keep my money. This is not going to happen.
If I don’t receive a response by Monday with A) A tracking number for the new, non-junk item being sent to me or B) A full refund in my Paypal account, I will inform eBay and Paypal of this transgression and exercise every available option to both receive a refund and let others know the nature of the backhanded shenanigans you are up to.
I am in no mood to debate this anymore with you, as you are fully aware of the situation and what you were doing when you sent the junk to begin with. All I want to know is whether you’re going to honor a refund or exchange. Please advise.
