I believe there is some discussion as to the illegality of WP munitions. I don't believe they are legally classified as WMD's, regardless of what effect they have. I could be wrong, but I'm almost positive according to international norms WP's are not illegal.

If they were used to specifically target civilians, clearly that's a war crime. If they were used against combatants, while not pretty, at least in my mind, I'm not convinced that constitutes a crime.
