Alot of the disenfranchisement stuff is so that enemy combatants and such aren't accorded the same due process as a citizen is.

Some of these include, right to an attorney, speedy trial, double jeopardy...ya know all the fun Bill of Rights stuff. When I read the recent enemy combatants case, the circuit court made it a really limited interpretation of its application. But at this point, people are being wary so as not to enrage too many people.

I think it would have to eventually get to the Supreme Court but I have no idea how it would come out. With the current make-up of Justices, it all comes down to O'Conner and/or Kennedy.
